Terms and conditions of use

1. General Provisions

These Terms of Use (hereinafter – “Terms”) govern the relationship between UAB Kinergo Baltik, registered in the Republic of Lithuania (address: Kauno g. 32, Vilnius, Lithuania, LT-03202, company code: 302784543, VAT number: LT100006880812), (hereinafter – “Seller” or “We”) and the user of the website www.transgear.lt (hereinafter – “Website”), including buyers (hereinafter – “User” or “You”). Access to and use of the Website, including browsing, registration, and placing orders, implies Your full and unconditional acceptance of these Terms. If You do not agree with the Terms, immediately cease using the Website. The Website is intended exclusively for the sale of automatic transmission spare parts and related goods to individuals and legal entities in the Republic of Lithuania and European Union countries.

2. Registration and Orders

Placing an order requires registration with the provision of accurate personal data (full name, email address, phone number, delivery address). The User is responsible for the relevance and accuracy of the provided information. Orders are accepted through the Website’s shopping cart. The product price is fixed at the moment of order confirmation by the Seller. We reserve the right to cancel or decline any order for any legitimate reason, including but not limited to: product unavailability, pricing mistakes, suspected fraud, or inability to deliver to your address. Order confirmation is sent to the User’s email. The sales contract is deemed concluded upon order confirmation and full payment.

3. Payment and Delivery

Payment is made online (by payment card, bank transfer) or in cash/by card upon receipt of the goods. All prices are indicated in euros including value-added tax (VAT). Delivery is carried out within the territory of the Republic of Lithuania and European Union countries. Delivery cost and conditions are agreed with the User through a manager after placing the order. Delivery terms: 3 to 7 business days from the moment of payment (approximately). The risk of accidental loss or damage to the goods passes to the User upon transfer of the goods. We are not liable for delays caused by third parties.

4. Return and Exchange

The User has the right to return a product of proper quality within 14 calendar days from the date of receipt, provided the product has not been used (not installed in a vehicle’s transmission), the original packaging, labels, and marketable appearance are preserved. Return of defective products is carried out within the warranty period. Return delivery costs are borne by the User. Refund is made within 14 days after inspection and acceptance of the goods. Custom-made, modified, or specially ordered products are non-returnable, except in cases of manufacturing defects.

5. Warranty Obligations

5.1. General Terms

UAB Kinergo Baltik guarantees the proper quality of all sold goods and performed works. Warranty obligations are valid in accordance with the legislation of the Republic of Lithuania and the European Union. The warranty covers material and assembly defects that appear during the warranty period, subject to proper installation and operation of the product.

5.2. Warranty Periods:

  • for new spare parts — 24 months (for individuals) / 12 months (for legal entities) subject to proper installation and compliance with manufacturer’s recommendations;

  • for remanufactured torque converters and other remanufactured transmission components — 6 months when installed at a specialized service station with documented confirmation of the work performed.

5.3. Warranty Conditions

The warranty is valid subject to the following conditions:

  • installation and removal of the product are performed at a specialized automatic transmission repair service;

  • full replacement of transmission fluid (ATF) has been carried out;

  • service documents contain the date, mileage, VIN or vehicle registration number, and details of the contractor;

  • a cash receipt, VAT invoice (PVM sąskaita-faktūra), or warranty card is provided. The decision on repair or replacement of the product is made by UAB Kinergo Baltik after inspection. The inspection results will be sent to the customer within a reasonable time after we receive and examine the item.

5.4. The Warranty Does Not Cover:

  • damage caused by careless transportation, improper installation, violation of operating instructions, or vehicle operation;

  • damage due to external factors (road accident, fire, flooding, corrosion, overheating, antifreeze entering the oil, etc.);

  • malfunctions caused by natural wear of other parts (metal or friction dust, traces of glycol or water in the oil, etc.);

  • indirect losses: vehicle downtime, loss of profit, costs of transmission removal and installation, transportation, and other expenses.

5.5. Claim Procedure

To consider a claim, the defective product must be delivered to the address: Kauno g. 32, Vilnius, at the buyer’s expense. It is necessary to provide: documents confirming purchase and installation, a description of the malfunction and contact details. After diagnostics, UAB Kinergo Baltik issues a conclusion: warranty denial (with reasons) or consent to repair/replacement with specified timelines. Parts replaced under warranty become the property of UAB Kinergo Baltik.

6. Liability

The Seller is not liable for indirect, incidental, or other losses, including lost profits, regardless of the cause. The Seller’s maximum liability is limited to the cost of the paid goods. The User uses the Website at their own risk. We take reasonable steps to keep the website secure and functional, but we cannot guarantee that it will run without interruptions, delays, or errors.

7. Amendments

The Seller has the right to amend the Terms at any time. The current version is published on the Website. Continued use of the Website after amendments implies agreement with them. We recommend regularly reviewing the Terms. All prices on the website are subject to change without notice. Your order price is locked in only after we send you the confirmation.

8. Applicable Law

These Terms are governed by the laws of the Republic of Lithuania. All disputes are resolved in a competent court at the Seller’s place of registration (Vilnius). If any provision of the Terms is found invalid, the remaining provisions remain in force.
